Regulations of the Website and “Baltic View Rewal” Apartments  

These Regulations lay down the rules of using the Website available on www.balticviewrewal.com and renting and booking of Baltic View Rewal Apartments offered by Agnieszka Ludwiczak. 

Definitions

§1

Unless stated otherwise, the terms used herein have the following meanings:  

  1. “Baltic View Rewal” means Agnieszka Ludwiczak, a natural person being a VAT payer (Tax Identification Number (NIP: 7871199913), with the following correspondence address: ul. Wiosenna 50, 62-081 Baranowo; e-mail: office@balticviewrewal.com, phone: +48604354600, being the service provider and the landlord; 
  2. “Website” means the website available on  www.balticviewrewal.com;
  3. “Guest” means a consumer or entrepreneur using the services of Baltic View Rewal, being a party to the short-term rental agreement made for tourism, leisure or professional purposes; 
  4. “Consumer” means a natural person who makes a reservation and enters into an agreement with Baltic View Rewal for a purpose not directly related to their economic or professional activity; 
  5. “Entrepreneur” means a person who makes a reservation and enters into an agreement with Baltic View Rewal as part of their economic or professional activity; 
  6. “WWW Page” means  – www.balticviewrewal.com;
  7. “Apartment” means a dwelling specified in the offer presented on the Website, which is the object of the short-term rental agreement made for tourism or leisure purposes;
  8. “Booking Form” means the form available on the WWW Page used to book the Apartment chosen by the Guest;
  9. “Business Day” means any day from Monday to Friday, except public holidays; 
  10. Regulations – these Regulations. For services provided by electronic means, the Regulations constitute regulations within the meaning of the Act of 18 July 2002 on electronic provision of services (Polish Journal of Laws of 2013, item 1422, as amended) and lays down the rules of services provided through the Portal; 

Applicability of the Regulations

These Regulations apply when booking an Apartment, cancelling a booking, confirming a booking, or concluding a short-term rental agreement with the Guests visiting the Website through the WWW Page.

Basic Information

§3

  1. The owner of the Website and the entity with whom a short-term rental agreement for tourism or leisure purposes is concluded is Agnieszka Ludwiczak, having the following correspondence address: ul. Wiosenna 50, 62-081 Baranowo; e-mail: office@balticviewrewal.com, phone: +48604354600 
  2. The controller of personal data processed in implementing the provisions hereof is Agnieszka Ludwiczak. Personal data are processed for the purposes, in the scope and on the basis of the rules set out in the privacy policy available on the WWW Page. The provision of personal data is voluntary. Any person whose personal data are processed by Baltic View Rewal has the right to view, update and rectify such data.
  3. Baltic View Rewal represents that it is the only owner of the Apartments offered for short-term rental and that it is entitled to provide the offered services.  
  4. The offers for the Apartments and their rental prices are indicative only and do not constitute an offer within the meaning of Article 66(1) of the Civil Code.
  5. Guest visiting the Website can be Consumers or Entrepreneurs that have accepted and comply with the Regulations.
  6. Every Guest booking an Apartment must read these Regulations. While booking an Apartment, the Guest must confirm that they have read the Regulations and accept them in the currently applicable wording by marking the appropriate field in the Booking Form. 
  7. The Apartment rental prices may be changed. The Guest is bound by the price in force at the moment of booking the Apartment.  
  8. Baltic View Rewal reserves the copyrights to any photos published on the WWW Page and does not allow their use for any purpose without the author’s consent. 
  9. Any matters related to the use of the Website, notifications for the purpose of initiating the complaint procedure, or any irregularities related to the operation of the Website can be reported by sending an e-mail to office@balticviewrewal.com or by calling us from Monday to Friday from 8:00 AM to 3:00 PM on +48604354600 .

Booking an Apartment

§4

  1. Baltic View Rewal publishes detailed information on the Apartments offer for short-term rental on the WWW Page.
  2. Guests may book an Apartment as follows:  
    • through the Booking Form available on the WWW Page – the Guest will be notified immediately on whether the Apartment is available and can be booked; 
    • by e-mail sent to office@balticviewrewal.com – the Guest will be notified by e-mail on whether the Apartment is available and can be booked; 
    • by calling us on +48604354600 – the Guest will be notified immediately on whether the Apartment is available and can be booked;
    • through external websites such as Booking.com or AirBnB – according to the rules applied by such websites. 
  3. A booking is confirmed once the online booking system assigns it a number that is then notified by telephone or sent to the Guest’s e-mail address. The information provided to the Guests also contains the price for renting the Apartment for the selected period and the amount of the booking fee. 
  4. The booking fee must be paid within the period agreed with the Owner.
  5. If the booking fee is not paid within the period set out in section 4, Baltic View Rewal will cancel the booking. 
  6. Paying the booking fee is a confirmation of concluding a short-term rental agreement for the period indicated by the Guest.
  7. All prices indicated on the Website are gross prices expressed in Polish Zloty (PLN). Baltic View Rewal is a VAT payer. 
  8. If the Guest did not receive a booking confirmation with a number, they should immediately contact Baltic View Rewal to confirm the booking. 
  9. The remainder of the rental fee for the Apartment must be paid no later than on the first day of stay in the Apartment.
  10. A natural person booking an Apartment must be over 18 years old and have full capacity to act in law. Persons under the age of 18 are required to hold a consent by their parent or legal guardian.
  11. The booking procedure carried out though the Booking Form on the WWW Page includes in particular:
    • choosing the Apartment and the dates of arrival and departure;
    • providing the Client’s details required for performing the agreement; 
    • choosing the method of payment; 
    • accepting these Regulations; 
    • granting a consent for the processing of personal data; 
    • clicking the “Book now” or a similar button on the Website.  
  12. A booking is made by completing the Booking Form and providing the details required to properly process the booking (such as the full name, phone number, address or e-mail).

Methods and Terms of Payment

  1. Payment for the short-term rental of the chosen Apartment is confirmed by Baltic View Rewal each time by telephone or e-mail. 
  2. The booking fee may be paid as follows: 
    • through a fast payment service:
      • Przelewy24 (PayPro SA with its registered office in Poznań at ul. Pastelowa 8 (60-198), entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court Poznań-Nowe Miasto i Wilda, 8th Commercial Division of the National Court Register, under KRS number 0000347935, Tax Identification Number (NIP): 7792369887;
      • PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A. 22-24 Boulavard Royal, L-2449 Luxembourg, Commercial register number: R.C.S. Luxembourg B 118 349 VAT number: LU22046007;
    • by wire transfer to the following bank account: Santander Bank S.A. 10109013620000000147167141
  3. The booking fee is 30% of the total rental fee and constitutes a non-refundable earnest money (unless agreed otherwise). The booking fee must be paid within the period set out in § 4(4) hereof. 
  4. The remaining fee for accommodation must be paid no later than on the day preceding the first day of stay in the Apartment.
  5. The price for accommodation includes the VAT and resort taxes. 

Amending and Cancelling a Booking

§6

  1. In the event the Guest withdraws the booking 30 or more days prior to the first day of stay, they may receive a 100% refund of the fee already paid. The amount paid will be refunded to the Guest’s bank account indicated upon booking or in a different way agreed with the Guest, no later than 7 days from the date when the booking was cancelled. 
  2. The booking period may be changed if the Apartment is available in the period selected. The rules and payment for the change are agreed with the Guest each time on an individual basis.
  3. In the event the Guest fails to arrive on the agreed date without prior notice, the Apartment is made available for another booking on the date following the date when the Guest was expected to arrive.  
  4. Baltic View Rewal may amend a booking made by the Guest by proposing another Apartment with at least the same area and parameters, without requiring the Guest to cover the difference in the price, only in the event of force majeure, as referred to in section 5 below, which prevents the rental of the selected Apartment. Baltic View Rewal shall immediately notify the Guest of such a change.
  5. Force majeure is understood as: 
    • strike,
    • war, 
    • natural disaster,
    • interruption in the supply of utilities such as electricity, gas, heating energy or water, for reasons not attributable to Baltic View Rewal.
  6. Where it is impossible to provide another Apartment, Baltic View Rewal Apartments will immediately notify it to the Guest and refund the amount paid for accommodation no later than 7 days of the date when the said circumstances occurred. 

Rules of Stay in an Apartment

§7

  1. A stay in an Apartment begins at 3:00 PM on the first day of the period booked (unless agreed otherwise). 
  2. Check-out must be made until 11:00 AM on the last day of the period booked (unless agreed otherwise). 
  3. On the day preceding the Guest’s arrival, the Guest will receive details of the check-in procedure (access codes to the building and apartment, etc.) by electronic means (e-mail and/or online messenger).
  4. All Guests remaining within the facility are required to comply with the night quiet time from 10:00 PM to 6:00 AM. 
  5. The Guest is required to use the Apartment according to its intended purpose and may not make any modifications in or outlays on the object of short-term rental. It is not allowed in particular to arrange any events for which the Apartment is not intended, such as stag parties, photo sessions, group business meetings, etc.
  6. Before leaving the Apartment, the Guest should exercise diligence to prevent any damage therein, i.e. switch off any electronic devices, switch off the light, make sure that the doors and windows are closed, etc. 
  7. In the event of damage, the Guest should notify Baltic View Rewal immediately. 
  8. In the event of damage, the Guest should notify Baltic View Rewal immediately. 
  9. Animals are not allowed in the Apartment. 
  10. The number of persons remaining in the Apartment must correspond to the number indicated as maximum upon booking.
  11. In the Baltic View Rewal Apartments, it is entirely prohibited to smoke (including electronic cigarettes) or light a barbecue grill at the balconies or terraces. 
  12. If the Apartment’s equipment is damaged or lost during the Guest’s stay and by the Guest’s fault, Baltic View Rewal may claim compensation for the loss incurred.
  13. The Apartments are fully equipped and prepared for the Guests, who have the obligation to care for the entrusted property. 

Protection of Personal Data

§8

  1. Clients’ personal data are processed in accordance with regulations in force, i.e. the Personal Data Protection Act (Polish Journal of Laws of 2002, No. 101, item 926, as amended) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) – from the date when the Regulation entered into force.
  2. Personal data of the Guests will only be used for the purpose of performing the agreement and will not be provided to third parties. The data are processed on the basis of Article 23(1)(3) of the Personal Data Protection Act and Article 6(1)(b) of the GDPR – from the date when it entered into force. The data will be stored until the expiry of the Guest’s claims arising from the agreement. 
  3. The Guest has the right to access their personal data and the right to amendment, rectification, deletion, restriction of processing, the right to data portability, and the right to object. 
  4. The data will not be subjected to automated processing, including profiling.  
  5. The data controller is Agnieszka Ludwiczak.

Final Provisions

  1. All rights to the WWW Page and any materials (photos, texts, graphics and other files) placed on the WWW Page are reserved.  
  2. To all matters not settled herein provisions of the Polish laws shall apply. 
  3. Any disputes which may arise between Baltic View Rewal and a Client that is not a Consumer shall be resolved by the court having jurisdiction over the registered office of Baltic View Rewal. 
  4. Baltic View Rewal may amend these Regulations. The amendment shall enter into force 14 days of being published on the Website’s home page. No amendment to the Regulations may apply to a booking made on the Website before the amendment entered into force.
  5. The current Regulations are published on the WWW Page and delivered to the Guest free of charge (by electronic means) at each request. The Client may access these Regulations at any time through the link available on www.balticviewrewal.com and may download or print them.
  6. The Regulations enter into force on 31/08/2023 and apply to any orders placed after that date.
